For the electronic dispatch of information on products and services, news, information about the company, invitations to trade fairs or events by e-mail, the customer magazine or the white paper (hereinafter “information on products and services”), we ask interested parties for their express consent to this Privacy Policy.

We use the so-called double opt-in process. This means that after registering, we will send you an e-mail to the e-mail address provided at the time of registration, asking you to confirm that you wish to receive information on products and services by e-mail. If you do not confirm your registration within 72 hours, your information will be locked and automatically deleted after one month. We store your given personal data, the time of registration and of confirmation. There are various contact forms available on our website which can be used to get into contact electronically, for downloading documents, such as the white paper, or to order documents by e-mail, such as the customer magazine. If a user uses a contact form, the data given in the user interface is transmitted to us and stored electronically. The transmission of this data is done in an encrypted form. The respective data can be seen directly in the user interface.

Prior to the processing of data, your consent is always obtained and reference is made to this Privacy Policy. Alternatively, you can contact us through the contact form or the e-mail addresses provided on our website. In this case the user's personal data transmitted by e-mail will be stored. The data is used exclusively for processing the request.

In cooperation with business partners (such as customers and suppliers) we process your personal data for the following purposes:

• Communicating with business partners about products, services, and projects, for example to process inquiries from the business partner;
• Initiation, execution, and administration of ((pre-) contractual) business relationships as well as maintenance of business relations between Frauscher and its business partner, for example to handle the ordering of products and services, to collect payments, for bookkeeping, billing and collection, and to carry out deliveries, maintenance or repairs;

The legal basis for the processing of this data is point (b) of Article 6(1) GDPR, because this data is needed so that we can fulfill our (pre-) contractual obligations to you.

If the personal data are not provided or not available to the required extent or if we cannot collect these, the individual described purposes may not be fulfilled or the request(s) may not be processed. Please note that this would not be considered a contractual default on our part.

The hosting services we use are for the purpose of providing the following services: infrastructure and platform services, computing capacity, storage and database services, security and technical maintenance services we use to operate this website.

In doing so, we or our hosting service provider processes inventory data, contact data, content data, contract data, usage data, metadata and communication data of customers, prospects and visitors to this website based on our legitimate interests in the efficient and secure provision of our website according to point (f) of Article 6(1) GDPR and Article 28 GDPR.

We publish vacancies on our website. In order to process your application, we collect, process and use all data provided by you in the course of the application to the extent permitted by law, even if this involves data within the meaning of Article 9 GDPR (such as religious affiliation). If you apply online, your application data will be encrypted. You agree that your personal data will be transferred to the appointed processor CORE smart work GmbH, Fillstraße 1, 4942 Gurten, Austria, for the purpose of the electronic administration of your application. Furthermore, you agree that your personal data may in individual cases and, if required by the application, be transmitted to all companies in the Frauscher Group for the purpose of processing your application. Apart from that, your personal data will only be used within the Frauscher Group and will not be shared with third parties. The data are accessible to Human Resources personnel and submitted to chosen executives.

If Frauscher concludes a contract of employment with an applicant, the transferred data will be stored and processed as employee data in accordance with statutory provisions for the purpose of executing the employment relationship.

1.1.2 Die Übermittlung von Daten geschieht ausschließlich unter Einsatz von SSL-Verschlüsselung, um die Sicherheit der vom Hinweisgeber bereitgestellten Daten zu gewährleisten. Wir nutzen keine Tracking-Tools oder Third-Party-Cookies auf der Website.

1.1.3 Das Hinweisgebersystem verwendet spezielle Verschlüsselungsmethoden, mit denen sichergestellt wird, dass ausschließlich der jeweilige Hinweisgeber sowie unsere zuständigen Compliance-Beauftragten Zugriff auf die bereitgestellte Meldung erhalten. Die in der Meldung enthaltenen Daten werden innerhalb unseres Unternehmens daher ausschließlich an den jeweils zuständigen Compliance-Beauftragten weitergegeben, eine sonstige Weitergabe an Dritte erfolgt (mit Ausnahme der allfälligen Weitergabe an zuständige Behörden oder Gerichte sowie Auditoren zur weiteren Verfolgung des der Meldung zugrunde liegenden Sachverhalts) nicht. Insbesondere besteht keine Zugriffsmöglichkeit auf Daten innerhalb der Meldung durch unsere Auftragsverarbeiter.

1.1.4 Abhängig davon, welche Daten Sie uns zur Verfügung stellen, verarbeiten wir folgenden personenbezogenen Daten:

• Identifikationsdaten des Hinweisgebers und des Beschuldigten (zB Name, Personalnummer)
• (private) Kontaktinformationen des Hinweisgebers (zB Adresse, E-Mailadresse, Telefonnummer)
• Funktion im Unternehmen
• Angaben zum Sachverhalt
• Kommunikation mit dem Compliance-Beauftragten
• Angaben zu Folgemaßnahmen (zB Untersuchungen)
• Technische Sekundärdaten (IP-Adresse des Zugriffs auf das Hinweisgebersystem)

Rechtsgrundlage: Art 6 Abs 1 lit c DSGVO - Erfüllung einer gesetzlichen Verpflichtung, nämlich Zurverfügungstellung eines internen Hinweisgebersystem gemäß § 8 iVm § 11 HinweisgeberInnnenschutzgesetz ("HSchG"). 

Sie können Meldungen über unser Hinweisgebersystem auch ohne Angaben zu Ihrer Identität erstatten. In diesem Fall bleiben Sie anonym.

• Für das technische Hosting des Hinweisgebersystems: RBS Responsible Business Solutions GmbH mit Sitz in Wien (es werden keine inhaltlichen Daten der Meldung übermittelt, sondern ausschließlich technische Sekundärdaten) sowie die technischen Sub-Auftragsverarbeiter A1 Telekom Austria AG und Wolf Rechtsanwälte GmbH & Co KG.
• Wenn eine Offenlegung erforderlich ist (i) aufgrund von Gesetzen oder Verordnungen oder (ii) zur Geltendmachung, Ausübung oder Verteidigung von Rechtsansprüchen, können wir personenbezogene Daten auch gegenüber zuständigen Behörden, wie Aufsichts-, Regulierungs- oder Strafbehörden, Gerichten oder anderen Dritten, die uns in diesem Zusammenhang beraten (z.B. Anwälte, Forensik-Experten oder Auditoren), offenlegen.

2.2 Ihre Daten werden ausschließlich innerhalb des EWR verarbeitet, eine Übermittlung in ein Drittland findet daher nicht statt.

3. Wie lange wir Ihre Daten speichern

3.1 Logfiles (siehe Punkt 3.3 oben) werden allgemein für einen Zeitraum von drei (3) Monaten aufbewahrt. Über diesen Zeitraum hinausgehend werden Logfiles nur zum Zwecke der Untersuchung von Unregelmäßigkeiten oder Sicherheitsvorfällen in unseren Systemen gespeichert. Zur Speicherdauer von Cookies siehe Punkt 3.5 oben.

3.2 Generell speichern wir Ihre personenbezogenen Daten nur so lange, wie dies für die Erfüllung des Zwecks, für den sie erhoben wurden, erforderlich ist. Sobald eine Meldung geprüft wurde, werden darin enthaltene personenbezogene Daten nach Ende der gesetzlichen Aufbewahrungsfrist gelöscht, sofern Nachforschungen nicht zu Disziplinarmaßnahmen oder einem gerichtlichen oder behördlichen Vorgehen führen.

3.3 Technische Sekundärdaten (IP-Adresse des Zugriffs auf das Hinweisgebersystem) werden ausschließlich in der Firewall des Auftragsverarbeiters verarbeitet und nach 24 Stunden gelöscht.
